摘要/Abstract

摘要： 发明构思一般是指在发明创造完成过程中,发明人为解决所面临的技术问题所提出的技术改进思路,由于在使用“三步法”进行创造性评判时,往往只考虑技术手段,容易忽视技术问题和技术效果,从而侧重对技术特征进行机械对比,导致创造性评判不准确。如果在进行创造性评判的过程中,能够结合发明构思进行全面考量,将有利于减少创造性评判上的偏差。

Abstract: Inventive concept generally refers to the technical improvement ideas proposed by the inventor to solve the technical problems faced during the completion of the invention and creation. When using the “three-step method” for creative evaluation,it is easy to overlook technical issues and effects,only consider technical means,and mechanically compare technical features,resulting in inaccurate creative evaluation. If comprehensive consideration is combined with the inventive concept in the creative evaluation process,it is beneficial to reduce the deviation in creative evaluation.
